Purchase to Enter
Normal-price purchases can generate entries through product codes, standard-rate SMS, phone or online registration without automatically creating a gambling stake.
Free Promotions
No-purchase social promotions based on commenting, sharing or liking are recognized by SZTFH as typical activities outside gambling.
Instant / Winning Moment
Pre-selected winning times, every-Nth-customer and certain immediate-win structures are typical models subject to the overall gambling test.
Paid / Premium Entry
A separate fee, premium-rate communication or price uplift linked to winning can constitute economic consideration and trigger gambling classification.
Typical Prize Tax
For a qualifying non-cash advertising benefit, the base is 1.18 times market value using 15% PIT and 13% social contribution. Other prizes require review.
LOCAL OPERATING CONTEXT
Hungary is a large and active Central European market for FMCG, retail, beverage, loyalty, banking, telecom and digital consumer activations.
Current structures can combine normal-price purchases with product codes, receipts, standard-rate SMS, online registration, loyalty activity, social participation, random draws and immediate-reward mechanics.
Since 2023, the central question is no longer whether a promotion fits the former gift-draw category. The key question is whether the campaign independently satisfies the legal definition of gambling.
Campaign rules should define the qualifying action, participant cost, prize structure, selection method, reserves, winner verification, tax treatment, privacy and marketing permissions before launch.
GMD coordinates these legal, technical, tax and operational elements through one campaign-management workflow.
Hungary supports purchase-linked, digital and immediate-reward mechanics when the gambling boundary and tax treatment are correctly managed.
Normal-price purchases can qualify participants who submit packaging or product codes through Web, SMS or another defined channel.
Receipt and invoice data can be collected and validated with duplicate, return, storno and winner-stage checks.
Standard-rate SMS, telephone and online registration are recognized participation routes for non-gambling promotions.
Eligible participants can be selected through controlled draws with predefined pools, reserves, protocols, logs and auditable records.
Pre-selected winning times, allocation logic and server-order rules can be fixed and audited before launch.
Every-Nth-customer, first-X-customer and immediate coupons can be used where the overall gambling test is not met.
Free campaigns requiring only a comment, share or like are typical promotional activities; platform and consent rules still apply.
Published merit, skill or judging criteria can replace random selection. A random tie-break can change classification.
Hungary abolished the former ajándéksorsolás promotional-draw category from 1 January 2023. Standard promotions are now primarily assessed against the general gambling definition rather than the old registration regime. Legacy templates referring to mandatory registration or universal notarial supervision should not be reused without review.
GMD can manage the complete campaign journey from mechanic classification and participation to winner selection, taxation and fulfilment.
