General Gambling Filing
No separate gambling licence or promotional-game filing has been identified for a campaign that qualifies for the statutory promotional-competition exclusion.
Purchase to Enter
The statutory definition expressly includes promotions based on purchasing goods or services and proving the qualifying purchase to the organizer.
Random Draws
Random winner selection can be used within the qualifying promotional framework, with equal participant conditions, defined rules and auditable selection records.
Instant / Winning Moment
Instant outcomes and pre-selected winning moments are design variants; the allocation method and overall structure should be classified before launch.
Prize Tax
For an individual standard promotional prize, the first EUR 350 per prize is exempt. Only the amount above EUR 350 enters the taxable base.
Cash Prize Tax
For standard taxable Slovak-source cash competition prizes, the organizer generally withholds 19% from the portion exceeding EUR 350.
LOCAL OPERATING CONTEXT
Slovakia is an active Central European market for FMCG, retail, loyalty, banking, telecom and digital consumer activations.
Campaigns can combine normal commercial purchases with fiscal receipts, product codes, standard-cost SMS, web registration, loyalty applications, social participation and digital prize mechanics.
The central legal question is whether the campaign qualifies as a promotional competition under Section 4(6). The mechanic should support the sale of goods or services rather than operate as a standalone gambling business.
Campaign rules should clearly define participation, equal eligibility conditions, prize allocation, winner selection, verification, taxation, claims, privacy and marketing permissions before launch.
GMD coordinates these legal, technical, tax and operational elements through one campaign-management workflow.
Slovakia supports a broad range of purchase-linked, digital and loyalty promotional mechanics within its promotional-competition framework.
Participants can submit fiscal receipt information through Web, SMS or campaign applications, with duplicate controls, eligibility validation and winner-stage proof checks.
On-pack or product codes can be validated through Web, SMS or mobile journeys and converted into eligible campaign entries.
Normal purchases, loyalty applications, customer accounts and qualifying transactions can generate promotional entries.
SMS, web registration and other digital channels can support receipt, code and participation journeys with clearly defined cost and communication conditions.
Eligible participants can be selected through controlled draws with predefined pools, reserves, protocols, logs and equal winner-selection conditions.
Digital Instant Win can be a campaign variant; allocation logic, prize inventory, eligibility and audit records should be documented before launch.
Pre-selected winning-time mechanics require documented timestamps, allocation logic, tie-break rules and equal participant conditions.
Knowledge, skill and judged creative campaigns use predefined subject, deadline, criteria, judges and scoring rather than a random draw.
For a standard individual promotional prize, the EUR 350 exemption is applied per prize. If a prize is worth more than EUR 350, only the amount exceeding EUR 350 enters the taxable income calculation — not the full prize value.
EUR 1,000 prize → EUR 350 exempt → EUR 650 taxable.
GMD can manage the complete campaign journey from promotional classification and participation to winner taxation and fulfilment.
